What they have in common is that the use is treated in planning law as a distinct type of commercial operation, typically permissible only in a commercial or industrial zone.

What matters for value is not the label but the combination of site permissibility, structural layout and an established track record. A building that has operated at the same location for decades and is known to the authorities has a starting position that is almost impossible to replicate with a new build.

Does a buyer take over the previous operator's official permit?+

No. The permit under Section 12 of the Prostitutes Protection Act (Prostituiertenschutzgesetz, ProstSchG) is issued to the operating person or company for a specific business concept and specific physical facilities. A new operator needs their own permit with their own reliability check. What transfers with the property are the structural and planning-law conditions.

Do banks finance properties of this kind?+

Some institutions rule out this type of use altogether, others assess it case by case. In our experience, the deciding factor is less the use itself than the building's suitability for alternative use, the buyer's equity ratio and creditworthiness. There is no blanket approval, so financing should be clarified early and against the specific property.

What about a different use after purchase?+

A change of use is conceivable but always decided case by case by the responsible building authority. The right first step is a written preliminary planning enquiry (Bauvoranfrage) to the local authority before any purchase contract is signed.

What is the commission?+

The buyer's commission is up to 5.95% including VAT of the purchase price, in line with the relevant agency agreement. It is earned and due on notarisation of the purchase contract.
